Terms of Service

1. The agreement

By creating a Zoomin account or using the service you agree to these terms. If you are agreeing on behalf of a company, you confirm you are allowed to bind it. If you do not agree, do not use the service.

2. Your account

You need a valid email address and you are responsible for what happens under your account, including keeping your password to yourself. Tell us promptly if you believe someone else has access. One account is for one person — sharing a login is not a substitute for a second subscription.

You must be at least 16 years old. We may suspend or close an account that breaks these terms, and we will tell you why unless doing so would be unlawful.

3. Your content

Your recordings are yours. We claim no ownership of them. You grant us only the licence we need to run the service — to store your recordings, convert them to a playable format, generate thumbnails, and deliver them to people you share them with. That licence ends when you delete the content or close your account.

We do not use your recordings to train machine-learning models, we do not sell them, and we do not give them to anyone else except where the law requires it.

4. What you may not record or share

You agree not to use Zoomin to store or share anything that:

  • infringes someone else's copyright, trademark or other rights;
  • records a person without a consent you are legally required to have — recording laws differ by state and country and complying with them is your responsibility;
  • is unlawful, defamatory, harassing, or sexually exploitative, particularly of minors;
  • contains malware, or is used to phish or defraud;
  • you were not permitted to capture in the first place.

We may remove content that clearly breaks these rules, and we will cooperate with valid legal process. We do not routinely watch your videos, so enforcement is generally in response to a report.

5. Plans, billing and cancellation

The Free plan is free, has the limits published on the pricing page, and does not require a card. Pro is billed in advance, monthly or annually, through Stripe. We never see or store your full card number.

You can cancel yourself at any time from the billing page. Cancelling stops the next renewal — your Pro features run to the end of the period you already paid for, and then the account returns to the Free plan's limits. We do not delete your recordings when you downgrade, but you will not be able to create new ones while you are over the Free limits.

Fees already paid are not automatically refundable. If something went genuinely wrong — a duplicate charge, a subscription you could not cancel, an outage that cost you the month — email us and we will sort it out.

We may change prices with at least 30 days' notice by email. A price change never applies to a period you have already paid for.

6. Availability

We work to keep Zoomin running and we do not promise it will never be down. There is no uptime SLA on either plan. Planned maintenance is kept short and, where practical, announced.

7. Deletion

Deleting a recording removes the file from storage and the row from our database. Deleting your account removes your recordings, your uploaded graphics, your sessions and your profile. Backups roll off within 30 days, after which the data is gone from those too. Anonymous aggregate counts that identify nobody may be retained.

8. Liability

The service is provided "as is". To the extent the law allows, Trail Optics LLC is not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the twelve months before it arose. Nothing here limits liability that cannot lawfully be limited.

Keep your own copies of anything important. Pro accounts can download the MP4, and you should, for anything you would be upset to lose.

9. Changes to these terms

We may update these terms. If a change materially affects you we will email you at least 30 days before it takes effect. Continuing to use Zoomin after that means you accept the new version.

10. Governing law

These terms are governed by the laws of the State of Colorado, USA, and the courts there have exclusive jurisdiction — except that either of us may seek an injunction wherever it is needed.
